Important changes relating to building, health and safety laws

March 2015
The Department of Commerce has provided information for us to pass on to our clients so that you are aware of your obligations under the Residential Tenancies Act 1987.  These are:

  • the lessor has an obligation to arrange for urgent repairs necessary to avoid exposing a person to the risk of injury; section 43(1); and
  • it is a term of every agreement that the lessor must comply with all requirements that apply to the premises in respect of building, health and safety laws; section 42 (2)(c) (in particular relating to blinds/curtains cords and chains and pool safety barriers).
